Privacy Policy.

The protection of your personal data is a top priority for asp. consulting GmbH and its affiliated companies within the meaning of ยง 189a Z 8 UGB (asp.group). Due to the nature of its activities, asp.group is committed to exceptional confidentiality and discretion.

Concerning data processing, asp.group is in particular subject to the provisions of EU Regulation 2016/679 of April 27, 2016, (General Data Protection Regulation, GDPR) and the Federal Act concerning the Protection of Personal Data (Datenschutzgesetz, DSG)

1.   Personal Data

Personal data is all data that contains individual details about the personal or factual circumstances of a person, such as their name, address, email address, telephone number, date of birth, age, gender, and social security number, but also video recordings, photos, or voice recordings of people.

2.   Processing of Personal Data

Asp.group processes personal data only if and insofar as asp.group has been given the appropriate consent, if it is necessary to fulfill contractual or legal obligations or to protect the legitimate interests of asp.group and if this does not violate any applicable law.

Where asp.group does not receive personal data from the data subjects themselves, asp.group receives this data from business partners or service providers. In addition, asp.group also collects individual personal data from public sources, such as company websites or LinkedIn, of course only if and insofar as this does not violate any applicable law.

The processing is carried out exclusively for the proper and efficient execution and processing of all business-related activities of asp.group, in particular, due to an existing or future business relationship, for compliance with legal obligations (e.g., in connection with retention periods, money laundering, terrorist financing, etc.), for the purposeful and efficient business management, for the maintenance and optimization of our contact management (CRM), and if there is any other legal basis in accordance with applicable law.

3.   Website Use

It is generally possible to use this website without providing your personal data. For statistical evaluation purposes, only technical data (IP address, time, and duration of the page visit) is recorded for the duration of your visit to the website and stored in anonymized form.

Furthermore, personal data about you is also collected if you provide it to asp.group. This may, for example, be data that you enter in a contact form or in connection with subscribing to a newsletter.

Asp.group processes your personal data based on your consent or a legitimate interest, for example to ensure the functionality and security of the website. You can revoke your consent at any time with immediate effect.

3.1   Cookies

Internet pages of asp.group use so-called “cookies”. Cookies are small data packets that are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain on your device until you delete them yourself or they are automatically deleted by your web browser.

3.2   Server-Log-Files

The provider of the website automatically collects and stores information in so-called Server-Log-Files, which your web browser automatically transmits to asp.group. Collected Information are following:

      • Browser type and browser version
      • Operating system used
      • Referrer URL
      • Host name of the accessing computer
      • Date and time of the server request
      • IP address

This data is not merged with other data sources. Asp.group reserves the right to check this data retrospectively in the event of concrete evidence of unlawful use. This data is collected based on asp.group’s legitimate interest in the technically error-free presentation, security, and optimization of our website – the server log files must be recorded for this purpose.

4.   Contact Management (CRM)

If you have contacted asp.group, your relevant information will be processed, such as name, medium and type of contact, reason for contacting us, etc.

The corresponding data processing is carried out to fulfill contractual or legal obligations or is in the legitimate interest of asp.group, for example, to maintain and optimize contact management. You can object to such processing at any time with immediate effect, for instance by sending an e-mail to office@asp.group. After due examination of the objection, further processing of your data will be discontinued. Otherwise, asp.group will inform you of any legitimate interests that prevent complete cessation.

5.   Data Security

5.1 Your personal data is protected by appropriate organizational and technical precautions. This particularly includes protection against unauthorized, unlawful, or accidental access, processing, use, manipulation, and loss.

Despite constant endeavors to maintain high standards of diligence, it cannot be ruled out that personal data processed by asp.group may be accessed or used unlawfully by third parties.

For this reason, asp.group accepts no liability whatsoever for the disclosure of information and/or unauthorized access by third parties due to errors for which asp.group is not responsible.

5.2 asp.group takes the security of your data very seriously and therefore aims to ensure that data breaches are detected at an early stage and, if necessary, that you or the responsible supervisory authority are notified, stating the category of data concerned.

6.   Use of Data in the Context of a Contractual Relationship

If you enter a contractual relationship with asp.group, you will disclose personal data and, if applicable, company and business secrets. With the corresponding disclosure, you implicitly declare that you have sufficient authorization to disclose this data. In any case, asp.group will only use this data to the extent necessary to establish and fulfill the contractual relationship.

Asp.group uses the data provided by you exclusively for purposes that are covered by applicable law. The use of anonymized data for statistical purposes is excluded from this.

7.   Storage of Data

Asp.group retains your data until the purpose for the data processing no longer applies or until it is necessary for the defense of any liability claims. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless there are other legally permissible reasons for storing your personal data. The retention periods differ depending on the respective processing purposes. On request, asp.group will provide you with specific information on the storage of your transmitted data.

8.   Your Rights regarding your Personal Data

8.1   As a data subject within the meaning of the GDPR, you have the right to information about your stored personal data, its origin and recipients, and the purpose of data processing and, if necessary, a right to rectification or completion of this data at any time within the framework of the applicable legal provisions.

8.2   You have the right to request the restriction of the processing of your personal data. The right to restriction of processing exists in the following cases:

      • If you dispute the accuracy of your personal data stored by us, it will take time to review your request. For the duration of the review, you have the right to request the restriction of the processing of your personal data.

      • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of completion.

      • If asp.group no longer needs your personal data, but you need it for the exercise, defense, or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of its completion.

      • If you have objected by Art. 21 (1) GDPR, a balance must be struck between your interests and those of asp.group. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

      • If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise, or defense of legal claims or the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

8.3   Many data processing operations are only possible with your expressed consent. You can withdraw your consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

8.4   If data processing is carried out based on Art. 6 para. 1 lit. e or f GDPR, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions. If you object, your personal data will no longer be processed by asp.group unless there are demonstrably compelling legitimate grounds for processing that outweigh your interests and rights, or the processing serves the establishment, exercise, or defense of legal claims (objection according to Art. 21 para. 1 GDPR).

8.5   You have the right to have data that is processed automatically by asp.group based on your consent or in fulfillment of a contract handed over to you or a third party in a commonly used, machine-readable format. You may request the direct transfer of the data to a third party of your choice, if not precluded by unreasonable efforts, legal or other confidentiality obligations. (Right to data portability)

9.   Miscellaneous

Asp.group reserves the right to update this data privacy statement if necessary. Reasons for this may include legal or technical requirements or changes to asp.group’s business activities.

Asp.group will endeavor to inform you immediately of any changes.
